John S. Stapleton is mentioned in Law360’s coverage of Yaw, et al. v. Delaware River Basin Commission regarding the defense of the Delaware River Basin Commission’s ban on high-volume hydraulic fracturing (i.e., fracking) in the Delaware River Basin.

Ultimately, LSSC client Delaware River Basin Commission prevailed in the Eastern District of Pennsylvania when the Court dismissed a challenge by certain Pennsylvania legislators, the Pennsylvania Republican caucus, and certain municipalities to the Commission’s ban on fracking. The matter is presently on appeal.

In 1961, New Jersey, Pennsylvania, New York, and Delaware and the United States enacted the interstate-federal Delaware River Basin Compact to provide for their joint administration of the water resources of the Basin.
